Introduction
Welcome to Garland's Carpet Cleaning Service. These Terms and Conditions ("Terms") govern your use of services provided by Garland's Carpet Cleaning Service ("Company," "we," "us," or "our"), located at 121 Eckel Rd, Little Ferry, NJ, 07643-2108. By engaging our services, you ("Client," "you," or "your") agree to these Terms in their entirety. Please read them carefully before scheduling or using our services.
These Terms constitute a legally binding agreement between you and Garland's Carpet Cleaning Service. If you do not agree with any part of these Terms, please do not use our services.
1. Service Agreement
1.1 Service Description
Garland's Carpet Cleaning Service provides professional interior cleaning services including, but not limited to, carpet cleaning, upholstery cleaning, air duct cleaning, and specialized surface cleaning for both residential and commercial properties. The specific services to be performed will be those selected by you and confirmed by us in a service quote or agreement.
1.2 Service Scheduling
All services must be scheduled in advance. We will make reasonable efforts to accommodate your preferred service date and time, subject to availability. Confirmation of your appointment will be provided via email or telephone. We reserve the right to reschedule appointments due to unforeseen circumstances, equipment failures, or adverse weather conditions that may affect service quality or safety.
1.3 Service Quotes
All quotes provided are estimates based on the information you provide and are subject to change upon in-person assessment. Final pricing may be adjusted based on actual conditions, including but not limited to: area size, level of soiling, additional requested services, or unforeseen circumstances discovered during service delivery. Any substantial changes to the quoted price will be communicated before work begins.
2. Client Responsibilities
2.1 Property Preparation
Prior to our arrival, you agree to:
- Remove small items, fragile objects, and valuables from areas to be cleaned
- Secure pets in areas separate from where cleaning will occur
- Inform us of any pre-existing damage, delicate items, or areas requiring special attention
- Ensure reasonable access to the property and cleaning areas
- Remove any items from floors in areas to be cleaned, unless furniture moving has been specifically included in your service agreement
Failure to adequately prepare the property may result in additional charges or inability to complete the scheduled service.
2.2 Property Access
You are responsible for ensuring our technicians have proper access to your property at the scheduled time. If entry cannot be gained at the appointed time, a cancellation fee may apply as outlined in Section 3.2.
2.3 Disclosure of Conditions
You agree to disclose any known conditions that may affect the cleaning process, including but not limited to: previous cleaning treatments, stains, water damage, pet accidents, or recent renovations. Failure to disclose relevant information may affect service outcomes and void any service guarantees.
3. Payment and Cancellation
3.1 Payment Terms
Payment is due upon completion of services unless prior arrangements have been made. We accept cash, checks, and major credit cards. For commercial or large-scale projects, a deposit may be required at the time of scheduling, with the balance due upon service completion. Returned checks will incur a $30.00 service fee in addition to any bank charges.
3.2 Cancellation Policy
We understand that circumstances may change. Our cancellation policy is as follows:
- Cancellations made with more than 24 hours' notice: No fee
- Cancellations made with less than 24 hours' notice: 25% of the quoted service price may be charged
- No-shows or cancellations after our technicians have arrived: 50% of the quoted service price may be charged
Repeated cancellations may affect future scheduling availability.
3.3 Late Payment
Invoices not paid within 30 days of service completion are subject to a late fee of 1.5% per month (18% per annum) or the maximum allowed by law. You agree to pay all costs of collection, including attorney fees, should such action become necessary.
4. Service Guarantees and Limitations
4.1 Satisfaction Guarantee
We strive to provide the highest quality cleaning services. If you are not completely satisfied with our work, please notify us within 48 hours of service completion, and we will return to address the specific areas of concern at no additional charge. This guarantee is limited to the original cleaning areas and does not cover new stains or soiling that occurs after our service has been completed.
4.2 Service Limitations
While we use professional techniques and equipment, certain conditions may limit our ability to achieve optimal results, including:
- Pre-existing permanent stains or damage
- Heavily soiled or neglected areas that have not been regularly maintained
- Manufacturer defects or improper installation of carpets, upholstery, or other surfaces
- Pet stains that have permanently damaged or discolored fibers
- Water damage or stains that have caused color loss or material damage
Our technicians will inform you if they encounter conditions that may affect cleaning results.
4.3 Excluded Services
Our cleaning services do not include:
- Hazardous material removal (including asbestos, mold remediation, or biohazards)
- Structural repairs or modifications
- Moving of heavy furniture unless specifically included in the service agreement
- Cleaning of antiques or extremely delicate items without prior written agreement
5. Liability and Insurance
5.1 Property Damage
While our technicians take reasonable care to prevent damage, we must be notified of any damage allegedly caused by our service within 48 hours of service completion. We will investigate all claims promptly. We are not responsible for:
- Pre-existing conditions or damage not caused by our technicians
- Ordinary wear and tear revealed by cleaning
- Damage to items that were not properly prepared or disclosed as requiring special handling
- Water damage due to structural issues or pre-existing conditions
5.2 Insurance
Garland's Carpet Cleaning Service maintains comprehensive business liability insurance. A certificate of insurance is available upon request. Our insurance does not cover pre-existing property conditions or damages not directly caused by our technicians.
5.3 Limitation of Liability
Our maximum liability for any claim arising from our services shall not exceed the total amount paid for the specific service that led to the claim. We are not liable for indirect, special, incidental, or consequential damages.
6. General Provisions
6.1 Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.
6.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any principles of conflicts of law. Any dispute arising from these Terms or our services shall be resolved exclusively in the courts of Bergen County, New Jersey.
6.3 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
6.4 Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including acts of God, natural disasters, pandemic, epidemic, weather events, government restrictions, or other events that make service delivery impossible or impractical.
